WILL OF RICHARD MUCKLESTON

 

Of Kily Owen Carmarthenshire

In the name of God Amen. The three and twentieth day of January in year of the reign of Charles our Sovereign, Lord Privy and Provost of England ***** thirteenth. I Richard Muckleston of the parish of Kily Owen diocese of St David in the county of Carmarthen Esquire being sick and weak of body but of sane and perfect memory God be praised do make and *** that my just will and testament in manner and form following. Firstly I do give my soul unto the almighty God having assuredly in the ** of the *** to be *** and as for my body I leave it to the earth whereof it was made to be decently interred in christian burial as it bequeath my *** and as my wife and friends shall think fit. Item. I give and bequeath towards the reparation of the Cathedral Church of St Davids aforesaid Ten Shillings and towards the reparation of said church of Kily Owen Twenty Shillings. Item. I give and bequeath to the poor of the parish of Kily Owen aforesaid Twenty Shillings. Item. I give and bequeath to my dear and loving wife Dame Elizabeth Aubrey the *** half of all my goods, chattels and personal effects and *** whatsoever as *** and portion to her due thereof. Item. I give and devise and bequeath unto the said Dame Elizabeth Aubrey all that capital, messuages and tenements and all the lands called Trebbany wherein *** lying in Kily Owen aforesaid together with all and singular *** messuages and tenements of lands with the appurtenances thereto belonging and herein hereafter mentioned viz one messuages tenements with appurtenances called Up Burlgh Trebbany in the tenure of Ruddle Rees William two other messuages called Trebonne Ucha Barreg Wenne now or later in tenure of Mauld the late wife of Rees William ap Rees and one other messuages and tenement of lands called Rhine Mallam at Rhine Mallam one other messuage tenement in the tenure of John Parry called Kily *** one other messuage tenement called Tirpenny Rhine one other messuage and tenement in the tenure of David ap Evan ap Meredith. One *** *** now in my own possession one other messuage and lands called *** *** *** in possession of Thomas Jenkins and one mansion house and tenement in the possession of ** *** one other messuage and tenement called ?Clan Davey? in the tenure of Griffith Morgan and ** *** or parcels of land there unto adjoining which I purchased of one Hugh Price one other messuage and tenement called Trebach in the tenure of David ap Evan ap Meredith and Hugh Thomas ap Rees all lying and being in the parishes of Kily Owen and LLanvorda in the said Oswestry. and one messuage with appurtenance called the ** Hall being in the town of Llanyddyfice in the said county. To have and to hold all and singular the said several messuages ** lands and premises with the appurtenances belonging unto the said Dame Elizabeth Aubrey and her assigns to *** to and charged with the several annuities and yearly wages unto hereafter mentioned during the term of her natural life and ** and after her decease to this ** behoof of Muckleston Allen Gent and his heirs forever (subject to the charges aforesaid) Item. All deeds ** and ** that do ** the said several premises or parts thereof I give and bequeath unto the said Dame Elizabeth Aubrey during her life and after her decease to the said Muckleston Allen forever. Item. Whereas I have a hundred pounds in mortgage of and upon ** lands of one Walter Sassone Gent lying in Llanwidwin in the said county of Carmarthen and now or late in the tenure of David Jenkins my will and true meaning is and I do hereby give and bequeath the said hundred pounds with the interest thereof of the same *** according to the limitations of the said deeds and mortgages unto the said Dame Elizabeth Aubrey. But if the said last mentioned premises for ** of payment of the said mortgage money become forfeit to me and my heirs according to the limitations of the said mortgage. Then I give devise and bequeath the said last mentioned premises with their appurtenances unto the said Dame Elizabeth Aubrey and her heirs forever. Item I give and bequeath unto the said Dame Elizabeth my wife *** gold and *** silver spoons. Item I give and bequeath unto John Allen my nephew all *** messuages and tenements of *** in *** in the said county of late in the tenure of Morgan David John Morgan to hold the tenure to the said John Allen during his natural life and for his or *** of the said John Allen lawfully begotten and to his heirs forever. Item I give and bequeath unto the said John Allen the sum of fifty pounds or thereabouts which I have in mortgage of *** lands of one David ap Hugh called *** *** lying in Llanvorda in the said county if the same be paid in redemption of the said premises *** and that the same become forfeited to me and my heirs aforesaid of just redemption. Then I give devise and bequeath the said messuages and lands called *** and all deeds and evidence thereunto belonging to the said John Allen during his natural life and after his decease to his said eldest son and his heirs forever. Item I give and bequeath unto the said John Allen *** pounds which I have in the hands of *** said David ap Hugh and one ** ***. Item. I give and bequeath unto my couson Marie Allen fourty pounds. Item. I give and bequeath unto my sister Margaret Williams wife of George Williams Gent ten pounds yearly during her life and after her decease to the said George Williams during his life five pounds to be assigned and paid unto them out of the lands and tenements by me hereby before devised to my said Dame Elizabeth my wife during her life and to the said Muckleston Allen after her decease forever at the *** feast of May Day and of Michael the Archangel yearly during their two lives *** formerly made according to my *** meaning herein. Item. I give bequeath and devise unto my nephew Richard Allen three pounds yearly during his life to be paid unto him issuing and paid from and out of my said messuages lands and tenements same charges as aforesaid at the feasts aforesaid by equal portions. Item. I give devise and bequeath fourty shillings yearly for *** to the poor of the town of Oswestry in the county of Salop to be dealt and distributed in bread amongst them upon every Good Friday by the discretion of the bailiffs of the said town and of the vicar and churchwardens thereof the time being. And my will is that the said payments shall begin upon the first Good friday and May Day next after my decease. And I do hereby charge the said messuages lands and tenements so mentioned to be charged with the said payments covering full power to the said *** *** there unto and their assigns when and as often as default be made of the said payment or of any of the same to enter into and distribute *** on all or any part of the said premises (so charged) till they be of the said payment or annuity and the *** thereof paid according to my ***. Item. I give and devise unto William David ap Rudder *** *** *** in Kily Owen wherein *** during his life. Item. I give and bequeath to Thomas ap John ap Evan one yoke of Oxen which I have in his custody. Item. I bequeath to Ruddr David Ruddr fourty shillings and to Anne Morgan five pounds. Item. I give and bequeath to John Allen the benefit of a judgement of five hundred pounds which I had against one David ap Harry ap Howell at the great sessions of the said county of Carmarthen and of the *** made of the lands of the said David ap Harry ap Howell lying in Llanvorda aforesaid in ** thereof willing that the said John Allen shall deal sensibly with the said David ap Harry ap Howell therein. Item. my will is that if the said Thomas John ap Evan shall *** will sufficiently assure to and upon John Thomas his *** and messuage and tenements and lands wherein he dwelleth living in Kily Owen aforesaid and to the heirs of the said John Thomas forever. Then I give devise and bequeath unto the said John Thomas all that messuages *** of lands with the appurtenances called Kily *** the appurtenances lying in Llanvorda in the said county to have and to hold the same and all deeds *** to and *** thereunto belonging to the said John Thomas and his heirs and assigns forever. Item. I give devise and bequeath unto the said Dame Elizabeth Aubrey my wife the Mansion House in Llanvorda wherein Rees Walter dwelleth and the *** land called *** during the *** *** therein and also the messuages and tenements called Y Carrig in Llanvorda aforesaid in the tenure of David Jenkins during the term of her natural life and after her decease to the said Muckleston Allen and his heirs forever. Item. I nominate and appoint the said Dame Elizabeth Aubrey my wife sole executrix of this my last will and testament and *** my loving friends Herbert Jones and my loving kinsman Hugh Muckleston Gent to be executors of this my will. A Contribution to the History of Talley Abbey.

"Forasmuch as David Thomas hath taken pains in drawing up of this survey for his majesties service, we do think fit to award and order that the said David Thomas shall receive at the next Court Leet, or before, from every of his majesties tenants, the sum of eight pence and from every under tenant four pence; and if in any case any of the said tenants do refuse to obey (the above) order, we then refer him to be amerced by Richard Muckleston, Gentleman, Steward of this Lordship, at the next Court Leet to beholden for the same"

Talley Abbey, situated in the North- Eastern portion of Carmarthenshire, in a narrow valley connecting the vales of the Cothi and the Towey. Talley was established as a Praemonstratensian house. The Praemonstratensian Oreder was a reformed branch of the Augustinian Canons.
