The Will of Paul Davis Muckleston formerly of 60 Packington Street Islington but late of 84 Woodstock Road Finsbury Park in the parish of Hornsey both in the county of Middlesex Gentleman who died 18 June 1890 at 84 Woodstock Road was proved at the Principle Registry by Joseph Rowland Muckleston of 25 Sussex Road Islington Shirt Collar Manufacturer the son and James John Speaight of 97 Fetter Lane in the City of London

Transcript of the Will:-

This is the last Will and Testament of me Paul Davis Muckleston of 60 Packington Street Islington in the County of Middlesex Gentleman I bequeath all my furniture plate linen china glass housekeeping stores books pictures and articles of household use and ornaments unto my dear wife Mary Muckleston for her absolute use and benefit I devise all the real estate to which I shall be entitled at the time of my decease (except estates vested in me as trustee or mortgagee) and I bequeath all the remainder of my personal estate to which I shall be then entitled to my son Joseph Rowland Muckleston and my son in law James John Speaight their heirs executors and administrators and assigns respectively upon trust to sell my real estate together or in parcels by public auction or private contact with power to make any special conditions as to title or evidence of title or otherwise and with power to buy in the promises at any public sale or to rescind either on terms or gratuitously any contract and to resell without being answerable for any loss and to convert and get in my residuary personal estate and after payment of my debts funeral and testamentary expenses and all costs charges and expenses of and incidental to the exercise of the trusts and powers herein contained to stand possessed of the residue of the monies to arise from such real estate and personal estate upon trust to invest the same upon such securities as trustees are by law authorised to invest in with power to vary and transpose such investments and to stand possessed of the income dividends and annual proceeds which shall arise from such investments upon trust to pay the same to my dear wife Mary Muckleston for and during the term of her natural life and from and immediately after her decease upon trust to divide my said residuary real and personal estate and the stocks funds and securities wherein or whereupon the same shall for the time being be invested into as many equal shares as the number of my children who shall be living at the decease of my said wife (having regard to the clause hereinafter contained as to my son William Davis Muckleston ) and upon further trust to pay one of such shares to each of my said children who shall have attained the age of twenty one years for his or her own use and benefit and to retain one of such shares for each of my said children living at the death of my said wife who shall not have attained twenty one years of age and to apply the income of each such last mentioned share for or towards the maintenance or education of each such child And in the event of any child living at the death of my said wife dying under the age of twenty one years I direct that the shares of each such child so dying or so much of such share as shall not have been applied for his or her benefit under the powers herein contained or referred to shall be paid to the children or child who shall be living at the death of the child and shall have attained twenty one years of age (having regard to the clause hereinafter contained as to my son William Davis Muckleston ) and if more than one equally between them And I declare that the shares whether original or accruity to any of my children being daughters shall become entitled under the trusts of this my Will shall be for their respective sole and separate use and free from the debts controls or engagements of any husband or husbands with whom they shall have intermarried or shall thereafter intermarry I empower my trustees as they shall in their discretion see fit to apply one half the share of any child under the age of twenty one years of age for his or her advancement in the world I direct my trustees to advertise for my son William Davis Muckleston who went abroad some years ago and from whom I have not received any communication for some two years last past and to take such steps as they may in their discretion think fit to ascertain whether my said son is living and if my trustees shall not succeed in ascertaining by the end of one year from the death of my said wife that my said son is living then I direct that he shall be deemed to have predeceased me without leaving issue and shall be excluded from the class among whom my residuary estate is hereinbefore made divisible and from all benefit under this my Will I empower my trustees to give receipts for all monies and effects to be delivered to them by virtue of my Will and declare that such receipts shall exonerate the persons taking the same from liability to see to the application and disposition of the said monies or effects therein mentioned I declare that all such powers and discretions as are by law exercisable by trustees may be exercised by my trustees and that all powers and discretions hereby given to the trustees herein named shall be exercisable by the trustees or trustee for the time being of my Will I appoint my said son Joseph Rowland Muckleston and my said son in law James John Speaight Executors of this my Will And I devise to the said Joseph Rowland Muckleston and James John Speaight all estates vested in me as trustee or mortgagee but declare that all monies receivable by virtue of any mortgage shall be dealt with as part of my general personal estate Lastly I revoke all other Wills In witness whereof I have hereunto set my hand this twenty fifth day of July one thousand eight hundred and seventy one - PAUL DAVIS MUCKLESTON - Signed by the testator Paul Davis Muckleston in the presence of us present at the same time who in his presence and in the presence of each other have subscribed our names as witnesses Tho Mytton Solicitor 3 Kings Bench Walk Temple J P Gaviard Clerk to Messrs Godwin Pickett and Mytton 3 Kings Bench Walk Temple

On the 31st October 1890 Probate of this Will was granted to Joseph Rowland Muckleston and James John Speaight the Executors
