The Will of Mary Muckleston (wife of the Reverend John Muckleston Clerk ) late of the City of Lichfield who died 17 November 1873 at Lichfield was proved at Lichfield by Theophilus John Levett of Wychnor Park near Burton upon Trent in the county of Stafford Esquire the nephew the surviving executor Probate being granted under certain limitations.

 

Transcript of the Will:-

This is the last Will and Testament of me Mary Muckleston wife of The Reverend John Muckleston of the City of Lichfield Clerk Whereas by an Indenture dated the thirty first day of March one thousand eight hundred and forty one made between the said John Muckleston of the first part myself (then Mary Levett Spinster) of the second part and Thomas Levett Princep and the Reverend John Hinckley of the third part (being a settlement made in contemplation of the marriage between myself and the said John Muckleston ) the capital sum of fifteen thousand pounds sterling or the securities on which the same were invested and the several sums of seven thousand five hundred and seventy five pounds fourteen shillings and one penny and nine hundred and ninety pounds two shillings and nine pence consolidated three pounds percent annuities were assigned unto and became vested in the said Thomas Levett Princep and John Hinckley upon trust to pay over the interest and annual produce of the same to myself for life and after my decease unto the said John Muckleston during his life and after the decease of the said John Muckleston then as to all and singular the said stocks funds and securities in trust for such person or persons and in such shares and proportions as I should by deed or by Will notwithstanding coverture from time to time give appoint or bequeath to how I the said Mary Muckleston In pursuance and in exercise and execution of the power limited to me by the said hereinbefore recited Indenture of Settlement and of every other proven enabling me in this behalf do by this my Will give and bequeath (subject to the life interest of the said John Muckleston ) the sum of six thousand pounds sterling part of the said trust funds unto my sister Frances wife of William Gist Esquire if she should be living at the time of the decease of the said John Muckleston but in the event of the said Frances Gist dying in the lifetime of the said John Muckleston then I direct that the said sum of six thousand pounds sterling shall be paid and transferred unto my three nephews William Westerna Gist Theophilus Gist and Francis Gist equally with benefit of survivorship between them but in the event of the death of either of my said nephews before their shares should become payable leaving issue then I direct that the share of such nephew so dying to be paid unto such issue in equal shares ( and as to the sum of five thousand pounds sterling other part of the said trust funds I give and bequeath the same subject to the life interest of the said John Muckleston to my sister Ann Levett absolutely if she shall be living at the time of the decease of the said John Muckleston but in the event of the said Ann Levett dying in the lifetime of the said John Muckleston then I direct that the sum of two thousand pounds part of the said sum of five thousand pounds shall be paid to my nephew Thomas Levett Princep and the sum of three thousand pounds other part of the said sum of five thousand pounds shall be paid in equal shares to my nephew Robert Thomas Kennedy Levett and to my niece Margaret Catherine Levett the share of the said Margaret Catherine Levett to be paid to her for her sole and separate use and free from the debts or control of her husband and in the event of the said Robert Thomas Kennedy Levett or Margaret Catherine Levett dying before their share of such sum of three thousand pounds shall become payable leaving issue then I direct the share of such of them so dying shall be paid to such issue equally ) And as to the sum of ten thousand pounds other part of the said trust funds I give and bequeath the same (subject to the life interest of the said John Muckleston ) as follows namely two thousand pounds to my nephew Theophilus John Levett the sum of two thousand pounds to my nephew Edward Levett the sum of two thousand pounds to my nephew Charles Richard Levett the sum of two thousand pounds to my nephew Henry Gordon Levett and the sum of two thousand pounds (residue of the said sum of ten thousand pounds ) unto my niece Sophia Frances Margaret wife of the Honourable and Reverend George Barrington Legge for her own absolute use and benefit free from the debts or control of her said husband and in the event of either of my said last mentioned nephews and niece dying in the lifetime of the said John Muckleston leaving issue such issue shall be entitled and equally if more than one to their deceased parents share but in the event of the death of the said Henry Gordon Levett in the lifetime of the said John Muckleston and without leaving issue then I direct that the said sum of two thousand pounds so given and bequeathed as aforesaid to the said Henry Gordon Levett shall be paid and transferred to the said Charles Richard Levett and Sophia Frances Margaret Legge in equal shares or to their issue if dead but such issue if more than one to take only and equally between them the share which their deceased parents would have taken if living at the decease of the said John Muckleston and as to the residue of the principle of such trust funds after the payment of all the expenses incidental to the said trust and to the proof and carrying into effect the trusts of my Will I give and bequeath the same unto my cousin The Reverend Charles Dickenson and wife Louisa Dickenson in equal shares with benefit of survivorship between them but in the event of the death of both of them the said Richard Charles Dickenson and Louisa Dickenson in the lifetime of the said John Muckleston then I give and bequeath the residue of the principle of such trust funds unto the said Robert Francis Kennedy Levett and Margaret Catherine Levett in equal shares the share of the said Margaret Catherine Levett to be for her sole use as aforesaid and in the event of the said Robert Thomas Levett or Margaret Catherine Levett dying before their share of such residue shall become payable leaving issue then I direct the share of such of them so dying shall be paid to such issue and equally if more than one All other the estate and effects of which I may die possessed I give and bequeath unto the said John Muckleston absolutely I appoint the said John Muckleston and Theophilus John Levett executors of this my Will In witness whereof I have hereunto set my hand this twentieth day of May One thousand eight hundred and sixty five

Signed by the said Testatrix as her last Will in the presence of us who in the presence of each other have hereunto subscribed our names as witnesses

Proved at Lichfield the twenty second day of August 1877 by the oath of Theophilus John Levett Esquire the nephew the surviving executor to whom Administration was granted limited to such personal estate and effects as the deceased by virtue of a certain Indenture of Settlement bearing date the thirty first day of March 1841 had a right to appoint or dispose of and has in and by her said Will appointed or disposed of accordingly but no further or otherwise

The Testatrix Mary Muckleston wife of the Reverend John Muckleston Clerk) was late of the City of Lichfield and died on the seventeenth day of November 1873 at the City of Lichfield aforesaid
