Muckleston Edith of Chiltern Cottage Totternhoe Bedfordshire Widow died 5th December 1951 Probate London 17th January to Thomas Lionel Turvey Farmer Effects £3192.

 

Transcript of the Will:-

This is the last Will and testament of me Edith Muckleston of Chiltern Cottage Totternhoe in the county of Bedford Widow.

1. I revoke all former testamentary dispositions made by me.

2. I appoint my brothers Thomas Lionel Turvey of Lockington Farm Totternhoe and Arthur John Turvey of 12 Dunstable Road Totternhoe (hereinafter called my "Trustees") to be the executors and trustees of this my Will for all purposes including hose of the Settled Land Act 1925.

3. I bequeath the following legacies free of duty:-

a) To my niece Patricia Ann Gillett the sum of two hundred and fifty pounds.

b) To my niece Bessie Frances Cumberland the sum of two hundred and fifty pounds and my kitchen cupboard.

c) To Mary Elizabeth Cumberland the daughter of my niece the sum of forty pounds.

d) To Veronica Ann Cumberland the daughter of my niece the sum of forty pounds.

e) To my niece Hilda Kate Cook the sum of two hundred and fifty pounds.

f) To Thomas Lionel Turvey and Arthur John Turvey the sum of fifty pounds and it is my wish but without creating any binding obligation that they will expend this legacy on the erection of a stone or kerb around the graves of Mr and Mrs Lamb and my sister Annie Turvey in Totternhoe churchyard.

g) To Thomas Lionel Turvey my four Sheraton mahogany dining room chairs, my Sheraton inlaid mahogany dressing table and wash stand, my Chippendale mahogany chest of drawers, all my silver, silver plate and cutlery.

4. I devise to my brother Thomas Lionel Turvey in fee simple all that my dwellinghouse known as Long View 59 Totternhoe Road Dunstable with the appurtenances thereto belonging. I direct that the estate and succession duty payable on my death in respect of this devise shall be charged on and paid by my residuary estate in exoneration of the property.

5. I devise my freehold properties known as Ivy Cottage Number 1 Furlong Lane Totternhoe and Pear Tree Cottage Number 13 Church Road Totternhoe with the appurtenances thereto belonging unto my Trustees in fee simple upon trust that my trustees shall permit my brother Arthur John Turvey to have the use and enjoyment thereof during his lifetime he keeping the said premises in tenantable repair and condition and insured against fire to the full value thereof in some office of repute to the satisfaction of my trustees and after the death of the said Arthur John Turvey my Trustees shall sell the said properties by public auction or private treaty and pay the nett proceeds of the sale to the Parochial Church Council for Totternhoe for general Church purposes and it is my wish but without creating any binding obligation on the Parochial Church Council that this money or some part thereof be used towards erecting a building in Totternhoe to be used as a Sunday School or for Church social activities. I direct that the estate and succession duty payable on my death in respect of this devise shall be charged on and paid by my residuary estate in exoneration of the property.

6. Subject as aforesaid I devise and bequeath all the remainder of my real and personal estate whatsoever and wheresoever unto my Trustees upon trust that my Trustees shall sell the said real estate and call in sell and convert into money with power to postpone such sale and conversion for such a period as my Trustees without being liable to account may think proper.

7. My Trustees shall out of the money arise from the sale and conversion of my said real and personal estate and out of my ready money pay my funeral and testamentary expenses death duties payable out of capital on my death and not charged on or payable out of other property and my debts and shall also pay or provide for the legacies hereby bequeathed but so that all legacies and the duty on all legacies bequeathed free of duty shall be paid primarily out of my personal estate.

8. My Trustees shall pay the residue of my estate to the Parochial Church Council for Totternhoe for general Church purposes and it is my wish but without creating any binding obligation on the Parochial Church Council that this money or some part thereof may be used towards erecting a building in Totternhoe to be used as a Sunday School or for Church Social activities. I direst that the estate and succession duty payable on my death in respect of this devise shall be charged on and paid by my residuary estate in exoneration of the property.

In witness whereof I have hereunto set my hand this twenty seventh day of November One Thousand Nine Hundred and forty six Signed by the said Edith Muckleston in the presence of both of us and by both of us in her presence:-

This is a codicil to the Will of me Edith Muckleston of Chiltern Cottage Totternhoe in the county of Bedford Widow which Will bears date the Twenty seventh day of November One thousand nine hundred and forty six

1. I bequeath the following pecuniary legacies free of all duties:-

a) To my niece Mrs Ethel May Plater of 119 West Street Dunstable the sum of two hundred and fifty pounds.

b) To my nephew Robert Francis Turvey of 84 Dunstable Road Totternhoe the sum of two hundred and fifty pounds

2. In all other respects I confirm my said Will
