Transcription of Administration and Will:-

Be it known that The Reverend Charles Edward Muckleston of The Vicarage Sandbach Heath Sandbach in the county of Cheshire Clerk formerly of Park House Sandbach in the said county who died on the 19th day of April 1932 at the Vicarage aforesaid made and duly executed his last Will and Testament. That the Reverend Edgar William James Hellins Clerk the surviving Executor and Residuary Legatee in trust named in the said Will has renounced the Probate and execution thereof And be it further known that at the date hereunder written Letters of Administration with the Will of all the estate which by law devolves to and vests in the personal representative of the deceased were granted by His Majesty's high Court of Justice at the District Probate Registry thereof at Chester to Louisa Gwendoline Muckleston of Ardenvale Diddington Lane Hampton in Arden in the County of Warwick Widow the Relict of the said deceased the Residuary Legatee for life named in the said Will and John Corbet Muckleston of Ardenvale aforesaid Salesman. The deceased did not die possessed of real estate Dated the 19th day of August 1932 Gross Value of Estate £118.18.11 Net Value of Personal Estate Nil. Extracted by Stringer and Hetherington Solicitors Sandbach.

Sureties Emily Muckleston of No 38 Heath Terrace Leamington Spa in the county of Warwick Widow and Mabel Emily Hughes of No 38 Heath terrace aforesaid Widow.

This is the last Will and Testament of me Charles Edward Muckleston of Park House Sandbach in the County of Cheshire Clerk in Holy Orders. I appoint Edgar William James Hellins of St Catherine College Cambridge and Arthur Victor Clements of Seven Rose Crescent Cambridge (hereinafter called my trustees) Executors and trustees of this my Will and to each of them I give the sum of fifty pounds free of legacy duty in consideration of their undertaking the execution and trust hereof and in addition to any further benefits they or either of them may take under this my Will. I direct my trustees to pay all my just debts and funeral and testamentary expenses as soon as conveniently may be after my decease. I give to my sister Mabel the sum of one hundred pounds. I give devise appoint and bequeath all the residue of my estate of whatsoever kind the same may consist and wheresoever situate to my trustees upon trust to sell call in and convert the same into money with power nevertheless to postpone such sale calling in and conversion for such time or times as my trustees shall think fit and to stand possessed of the proceeds thereof or any part thereof upon trust to invest the same in or upon any stock funds or securities authorised by any statute for the time being in force for the investment of trust funds or in or upon any of the investments following that is to say in the purchase or mortgage of any real or leasehold securities in England or Wales (providing such leaseholds should have at least sixty years unexpired) or in or upon the stock shares or securities of any British Colony or Dependency (provided the same are not payable to bearer) or in or upon the debenture stock or preference shares or stock (provided the same are not payable to bearer) of any public or private company carrying on business in the United Kingdom or in any British Colony or Dependency which has paid a dividend of not less than three percent on the ordinary stock or shares for each of the three years prior to the date of investment or in or upon the stock or securities (provided the same are not payable to bearer) of any municipal corporation local authority or public body in the United Kingdom authorised to create stock or borrow money or upon the security of any life interest in real or personal property together with a policy on the life of the person having such life interest upon trust to stand possessed of such investments and of such parts of my estate as may be unsold and outstanding which investments and securities are hereinafter called my trust fund upon trust to pay the income thereof to my wife Louisa Gwendoline during her life without power of anticipation and after her death both as to capital and to income thereof upon trust for such child or children or remoter issue of mine who being a son or sons attains the age of twenty one years or being a daughter or daughters attains that age or marry and if more than one in equal shares as tenants in common and if there shall be only one such child then the whole to be in trust for that one child and if there shall be no child of mine who being a son attains the age of twenty one years or being a daughter attains that age or marries then I give devise and bequeath my trust fund after the death of my said wife to my said sister Mabel absolutely and I hereby declare that my trustees may at any time or times with the consent in writing of my wife during her life and after her death at the discretion of the trustees raise any part or parts not exceeding one moiety of the vested or presumptive share of any child or other issue of mine under the trusts or powers aforesaid and may apply the same for his or her advancement or benefit or as my trustees shall think fit and I hereby declare that my trustees if they think fit instead of acting personally employ and pay a solicitor or any other person to transact any business or do any act required to be done in connection with the trust including the receipt and payment of money and that any trustee being a solicitor or other person engaged in any profession or business may be so engaged and shall be entitled to charge and be paid all professional and other charges for any business and act done by him in connection with the trusts of this my Will including any act which a trustee not being a solicitor or other person engaged as aforesaid could have done personally and I hereby declare that the power of appointing new trustees shall for the purpose of these presents be vested in my said wife for her life and that the personal representatives or representative for the time being of a last surviving or continuing trustee may act as the trustees or trustee of this my Will until the appointment of a new trustee or trustees. i revoke all prior Wills and testamentary dispositions heretofore made by me and declare this to be my last will contained in this and the preceding sheet of paper which I make this fourteenth day of July one thousand nine hundred and three -CHARLES E MUCKLESTON-

Transcript of the Will:-

I Louisa Gwendoline Muckleston known as "Gwendoline Muckleston" of 55 Copthorne Road Shrewsbury in the county of Salop widow hereby revoke all testamentary dispositions heretofore made by me and declare this to be my last Will which I make this 17th day of June one thousand nine hundred and forty two

1. I appoint Williams Deacons Bank Limited hereinafter called the bank and my son John Corbet Muckleston hereinafter called my executors to be the executors and trustees of this my Will and so that the appointment of the bank shall be upon the terms and conditions and with the right to renumeration specified in the banks published Trustee prospectus and scale of fees in force at the date hereof

2. I bequeath the following legacies namely the sum of ten pounds to Mrs Ethel Barbara Pickwell of Diddington Farm Meriden near Coventry and the sum of five pounds to Mr Thomas Edgar Bayley of the Glen Manor Lane Sandbach Heath Cheshire in each case free of duty.

3. I give devise and bequeath the residue of my estate of whatsoever kind and wheresoever situate unto my said son John Corbet Muckleston absolutely but if he should predecease me then and provided that she shall survive me I give devise and bequeath the same to his wife Dorothy Amy Muckleston in affectionate recognition of her unfading care of and attention to me during my several illnesses

4. 1) If my said son and daughter in law shall predecease me then I give devise and bequeath the residue of my said estate to the bank upon trust that the bank shall convert into money such part thereof as does not consist of money with power to postpone such sale and conversion for such a period as the bank without being liable to account may think proper

2) The bank shall out of the money to arise from the sale and conversion aforesaid and out of my ready money pay my funeral and testamentary expenses and debts and shall also pay the duties on the pecuniary legacies aforesaid and shall stand possessed of the net amount of the residue of my said estate in trust for such child or children of the marriage of my said son and daughter in law as shall attain the age of twenty one years and if more than one in equal shares as tenants in common but should there be no child or children of the said marriage who shall attain the age aforesaid then I declare that the net amount of the residue of my said estate shall be held in trust for the poor Clergy Relief Corporation of Number 49 Coverdale Avenue New Malden in the county of Surrey to be devoted to the general purposes of the said corporation and I declare that the receipt of the treasurer of the said corporation shall be a sufficient discharge to the bank.

3) The statuary advancement clause shall apply for the benefit of the children of the marriage of my said son and my said daughter in law

This is a codicil to the Will of me Louisa Gwendoline Mucklestone known as Gwendoline Mucklestoneformerly of Number 55 but now of Number 45 Copthorne Road Shrewsbury in the county of Salop Widow.

I hereby revoke the bequest of a legacy of ten pounds to Mrs Ethel Barbara Pickwell as set out in paragraph 2 of my will

In all other respects I confirm my said Will
