JOHN MUCKLESTON

In the name of God Amen. I John Muckleston of Bicton in the county of Salop Esquire being indisposed in health but of sound mind and memory praised be Almighty God do this thirty first day of March in the year of our Lord God one thousand seven hundredtwenty and two make this my last Will and Testament in manner and form following that is to say I recommend my soul into the hands of Almighty God my creator hoping for pardon of all my sins through the infinite mercy and merits of my blessed God and saviour Jesus Christ and my body to be buried according to the discretion of my executrix hereafter named in Christian burial and as for what personal estate I shall die possessed ofand concerning what real estate I am and shall die seized of in possession or reversion situate and lying in the several parishes of Oswestry, Selattin, Olbury?, and Cardon?, in the said county of Salop and which amongst other things and premises I and Ann my wife have lately acknowledged of me. I do give and dispose of in manner following that is to say all my household goods of what kind so ever place *** of the ground I have in my possession and implements of husbandry I do give and bequeath unto my loving wife Ann Muckleston and my daughter Letitia Muckleston to be equally divided between them together with what ready money I shall have in my keeping at my death and that the same request and things bequeathed shall not be employed in paying my debts but to go to their sole use and benefit I by this my will making provision for paying the same out of my real estate hereinafter mentioned and in order thereunto my mind and will is that my said wife shall receive her thirds out of all the lands and tenements that I have or shall be seized of in my lifetime. Item. I give devise and bequeath unto my said wife Ann Muckleston and my Uncle Joseph Muckleston of the said county of Shrewsbury Grocer all my messuages lands and tenements with their and every of their appurtenances which I am in any kind seized of, in possession remainder or reversion situate and being in the several parishes aforesaid to hold to them the said ann my wife and my said Uncle JosephMuckleston their executors administrators and assigns for and during the term of five hundred years commencable from the day of my death and therefore fully to be complete and ended in trust that they their executors and administrators shall raise out of the rents issues and profits of the said messuages lands and tenements or by leasing mortgaging or selling the same premises or some part thereof for the raising of such sum and sums of money as shall pay and discharge my just debts in any kind by firstly owing not impeding my said wifes thirds and upon this further trust that after the said monies shall be raised as aforesaid and they their executors and administrators defrayed the charges they and every of them shall be at committing of the said trust that then on this further trust that they their executors and administrators shall surrender and give up the said trust estate to the person or persons that shall then have the immediate title thereto and to attend the estates and inheritance thereof and after the said trust is performed and now at present subject to the said trust and my wifes thirds I do give and devise all and singular the said messuages lands and tenements with their several appurtenances unto my said daughter Letitia Muckleston and her heirs forever and in case my said daughter shall die and depart this life before she shall attain the years of one and twenty then I do give and devise all and singular the said messuages lands and tenements with their several appurtenances unto my said loving wife Ann Muckleston and after her decease the said Letitia dying as aforesaid I do charge the said messuages lands and tenements with the payment of the sum of five hundred pounds of lawful money of Great Britain to be paid unto my said uncle Joseph Muckleston his executors administrators and assigns and for the better securing the payment thereof I do devise the said messuages land and premises after my said wifes decease and my said daughter having died as aforesaid unto my said uncle Muckleston his executors and assigns for the term of twenty years nevertheless my mind is and it is conditioned that if the person or persons that shall have the then immediate possession and inheritance of the said premises or right thereto shall pay the said sum of five hundred pounds unto the said Joseph Muckleston and his assigns within six months after my said wifes decease my said daughter dying within the times aforesaid that from thereforth the said term of and twenty years shall raise from. I do hereby make constitute and appointing my wife Ann Muckleston to be guardian to my said daughter Letitia during her minority and until she attains her age of one and twenty and of this my will I make my loving wife Ann to be my sole executrix desiring the said uncle Mucklestons assistance and advice when required and I do hereby revoke all former wills by me made. in witness whereof I have put my hand and seal the day and year first above written John Muckleston. Sealed signed and published by the said John Muckleston to be his last Will and Testament in the presence and sight of us who subscribed our names as witnesses hereto in his presence Martha Tonge, Adam Newling, Arthur Tonge, Elizabeth ***.
